Terms of use

These terms govern the use of the FifthSet web app (fifthset.app) and the FifthSet app for iOS and Android. They are provided by the operator named in the imprint ("we"). By creating an account you accept them. Using the mobile app includes the usage and crash reporting described in the privacy policy; you can turn it off in Profile.

The service is free of charge. It is a private hobby project, offered as-is to friends and their friends, not a commercial product.

FifthSet lets a private group predict the winners of Grand Slam tennis matches and compare scores on a leaderboard. Points are for bragging rights only.

There is no money involved: no entry fee, no stakes, no prizes from us. You must not use FifthSet to organise gambling or betting for money or anything of value. We are not a gambling provider, and we may close groups or accounts used that way.

FifthSet is not affiliated with, endorsed by or sponsored by the ATP, the WTA, the Grand Slam tournaments, ESPN or any player. Match data comes from a public sports-data source and may be delayed, incomplete or wrong.

You sign in through our authentication provider (WorkOS AuthKit). For your account you agree that:

• you are at least 16 years old;
• you create only one account and use it yourself;
• you keep your login (email inbox, passcode, social login) secure and tell us if you suspect misuse;
• the name you show to your groupmates is not misleading.

Names and approved profile photos are shown to other people. Each group admin reviews new photos before they appear in that group. Approval in one group does not publish a photo in another. You must not use content that is:

• illegal, or that incites hatred or violence;
• insulting, harassing, discriminatory or pornographic;
• impersonating another person, a player or an organisation;
• infringing someone else's rights, e.g. a photo you have no right to use;
• designed to disrupt the service, such as automated picking, scraping or exploiting bugs.

You explicitly accept these community rules before participating. Report inappropriate names or photos from the members list, or report a group name from group information. You can block members to hide their names and photos; scores and predictions remain visible. We review reports and may remove content and suspend abusive accounts. Contact support with questions.

Groups are private. Anyone with the invite link can join; the group owner may remove members and reset the invite link.

Your picks are hidden from other members until the match locks. Picks lock at the match's scheduled start time (earlier if it goes live before that). Your groupmates' picks are revealed only once our data source confirms the match is under way or finished — for a delayed match that can be later than the scheduled time. From then on they are visible to everyone in the group, along with your points. That is the game. A group owner may set a cut-off; matches that started before it are outside the group's window and are not picked or scored by anyone.

Scoring follows the published rules. Results, walkovers and retirements are applied as reported by the data source; if a result is corrected, points are corrected with it.

We run FifthSet in our spare time. We aim to keep it available around the Grand Slams but do not guarantee uptime, error-free operation or that data is never lost. Please do not rely on it for anything important.

Rounds may open late, results may arrive late, and push notifications or emails may not be delivered — none of this creates a claim against us.

We may change, limit or discontinue the service or parts of it. If we shut it down we will try to announce it in advance.

You can delete your account at any time in Profile → Delete account. Your picks, memberships and uploaded pictures are removed as described in the privacy policy.

We may terminate or suspend your account if you violate these terms, if required by law, or when the service is discontinued.

FifthSet is provided free of charge. We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, and under mandatory law such as product liability.

For slight negligence we are liable only for the breach of an essential obligation — one whose fulfilment makes the use of the service possible in the first place and on which you may regularly rely — and then only for the foreseeable damage typical for this kind of free service.

Any further liability is excluded. This does not limit your statutory rights as a consumer.

We may update these terms when the service changes or the law requires it. We announce changes in the app or by email; the date at the top shows the current version. If you do not agree, delete your account.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer in another EU country, the mandatory consumer protections of your country of residence remain unaffected.

We are neither obliged nor willing to take part in dispute-resolution proceedings before a consumer arbitration board.

Should a provision of these terms be invalid, the remainder stays in force.
